1. Introduction

Quick Sauda is an e-commerce platform that connects users, sellers, farmers, and service providers. Our services include online grocery, pharmacy, food delivery, shopping, farming solutions, parcel delivery, and on-demand services.

2. Acceptance of Terms

By accessing or using the Quick Sauda platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. We reserve the right to modify these terms at any time, and continued use of our services constitutes acceptance of the modified terms.

3. User Accounts

• Users must create an account to access the services.
• You are responsible for maintaining the confidentiality of your login credentials.

4. Order Placement and Acceptance

5. Payment Terms

• Quick Sauda accepts various payment methods including credit/debit cards, digital wallets, and cash on delivery.
• You agree to pay all charges incurred by your account, including applicable taxes.
• In case of payment failure, we reserve the right to cancel your order.
• For cash on delivery orders, you must pay the exact amount to the delivery executive.

Our platform may contain links to third-party websites or services that are not owned or controlled by Quick Sauda. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that Quick Sauda shall not be responsible or liable for any damage or loss caused by your use of any such third-party services.

9. Termination

We may terminate or suspend your account and access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms and Conditions. Upon termination, your right to use the service will cease immediately.

10. Liability Disclaimer

Quick Sauda acts only as a technology and delivery facilitator. We do not guarantee product quality, safety, or legality.

• No Responsibility for: losses, delays, cancellations, or seller non-compliance.
• Maximum Liability: limited to refunding the order value.
• Quick Sauda shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
• We do not guarantee uninterrupted, secure, or error-free service.

11. Indemnification

You agree to indemnify and hold harmless Quick Sauda and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of your use of the platform or violation of these Terms and Conditions.

12. Force Majeure

Quick Sauda shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, government actions, natural disasters, or internet service disruptions.

13. Severability

If any provision of these Terms and Conditions is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

14. Changes to Terms

We reserve the right to modify or replace these Terms and Conditions at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

15. Entire Agreement

These Terms and Conditions constitute the entire agreement between you and Quick Sauda regarding your use of the platform and supersede all prior and contemporaneous agreements, proposals, or representations, whether written or oral.

16. Waiver

No waiver of any term of these Terms and Conditions shall be deemed a further or continuing waiver of such term or any other term, and Quick Sauda's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

17. Assignment

You may not assign or transfer these Terms and Conditions, by operation of law or otherwise, without Quick Sauda's prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be null and void. Quick Sauda may freely assign or transfer these Terms without restriction.

18. Notices

Any notices or other communications provided by Quick Sauda under these Terms will be given by posting to the platform, sending to the email address associated with your account, or by any other method we determine appropriate.

19. Relationship of Parties

Nothing in these Terms and Conditions shall be construed as creating a joint venture, partnership, employment, or agency relationship between you and Quick Sauda.

20. Governing Law

This Agreement is governed by the laws of India. Any disputes shall be subject to the courts of Bihar, India.

Quick Sauda - Rider Policy & Safety

This policy governs ride-hailing services with a primary focus on user safety and conduct.

1. Booking and Identity

• Users must provide accurate pickup and drop locations.
• Safety Check: Always verify the vehicle plate number and driver photo on your app before boarding.
• Wait time charges may apply if the rider is not present at the pickup point within 5 minutes.

2. Emergency & SOS Features

• The in-app SOS button notifies local authorities and our safety response team immediately.
• Riders should use the 'Share Live Trip' feature to allow friends or family to track their ride.

3. Rider Conduct

• Riders must treat Driver Partners with respect.
• Smoking, drinking, or any illegal activity inside the vehicle is strictly prohibited.

Quick Sauda - Driver Partner Safety Agreement

1. Eligibility & Documentation

• Drivers must hold a valid commercial Driving License and all required vehicle permits (RC, Insurance, PUC).
• All partners must pass a mandatory background and criminal record verification.
• The vehicle must be maintained in safe, clean, and roadworthy condition.

2. Mandatory Ride Verification (OTP)

• Ride Security: No ride should start without entering the correct OTP provided by the rider. This ensures passenger verification.

3. Operational Safety

• Drivers must follow all traffic laws. Over-speeding or reckless driving will lead to immediate deactivation.
• Rude behavior or harassment of any kind will result in a permanent ban from the platform.

Quick Sauda - Seller Agreement

1. Seller Eligibility

• Sellers must be at least 18 years old and have the legal capacity to enter into contracts.
• Sellers must possess all necessary licenses, permits, and registrations required to sell their products.
• Sellers must maintain valid business registration, GST, FSSAI (if applicable), and other required certifications.
• Sellers must have a valid Indian bank account for receiving payments.

2. Seller Responsibilities

• Maintain all required business licenses (GST, FSSAI, etc.) and display them on your store page.
• Ensure product quality, safety, and compliance with all applicable laws and regulations.
• Accept orders within 5 minutes and prepare them promptly for pickup.
• Handle customer complaints, returns, and replacements as per Quick Sauda policies.
• Provide accurate and complete product information, including clear images, detailed descriptions, and correct pricing.
• Maintain adequate inventory levels to fulfill orders and update stock availability regularly.
• Package products securely to prevent damage during transit and ensure proper labeling.
• Adhere to all packaging and labeling requirements as per Indian laws.

3. Product Listings and Content

• Sellers are solely responsible for the accuracy and completeness of their product listings.
• Product images must accurately represent the actual product and show all relevant details.
• Prohibited items (illegal substances, counterfeit goods, weapons, etc.) may not be listed on the platform.
• Quick Sauda reserves the right to remove any listing that violates our policies without prior notice.
• Sellers must categorize products correctly and provide all required product attributes.

4. Order Fulfillment

• Sellers must accept orders within 5 minutes of receiving them through the platform.
• Orders must be prepared and ready for pickup within the specified timeframe for each category.
• Sellers must notify Quick Sauda immediately if they cannot fulfill an order due to stock issues or other reasons.
• Repeated order cancellations or failure to fulfill orders may result in suspension or termination of seller account.
• Sellers must maintain a cancellation rate below 5% to remain in good standing.

5. Payment Terms

• Payouts will be transferred to your registered bank account weekly after deductions of platform fees, commissions, and any applicable taxes.
• Refunds due to seller faults will be deducted from future payouts.
• Commission rates and fees are subject to change with 30 days' notice to sellers.
• Sellers are responsible for all taxes associated with their sales and must file returns accordingly.
• Payment disputes must be raised within 7 days of the payment date through the seller dashboard.
• A detailed statement of all transactions, fees, and payouts will be available in the seller dashboard.

6. Customer Service

• Sellers must respond to customer inquiries and messages within 24 hours.
• Sellers must handle returns, replacements, and refunds according to Quick Sauda policies.
• Sellers must maintain a minimum customer satisfaction rating of 4.0 stars as determined by Quick Sauda.
• Negative reviews and customer complaints should be addressed professionally and promptly.

7. Intellectual Property

Sellers represent and warrant that they have all necessary rights to the content they upload to the platform, including product images and descriptions. Sellers grant Quick Sauda a non-exclusive, worldwide, royalty-free license to use, display, and distribute their content on the platform for the duration of this agreement.

8. Data Protection

Sellers agree to comply with all applicable data protection laws and regulations, including the Information Technology Act, 2000 and related rules. Sellers may only use customer information for order fulfillment and may not share, sell, or misuse this information. Sellers must implement reasonable security practices to protect customer data.

9. Termination

Either party may terminate this agreement with 30 days' written notice. Quick Sauda may suspend or terminate a seller's account immediately for violation of this agreement or our policies. Upon termination, sellers must remove all their content from the platform and settle any outstanding payments or obligations.

10. Limitation of Liability

Quick Sauda's liability to sellers is limited to the commission fees paid to Quick Sauda in the 3 months preceding the claim. Quick Sauda shall not be liable for any indirect, incidental, or consequential damages, including lost profits or business opportunities.

11. Indemnification

Sellers agree to indemnify and hold harmless Quick Sauda from any claims, damages, or losses arising from their products, content, or violation of this agreement, including any legal costs incurred by Quick Sauda in defending such claims.

12. Governing Law

This agreement is governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Bihar, India.

Quick Sauda - Privacy Policy

14. Manual Account Deletion

We provide users with the right to delete their accounts and all associated personal data at any time. You can initiate a deletion request directly through the 'Account Settings' section within the app or by contacting our support team. Upon receiving a request, your personal information, order history, and saved preferences will be permanently removed from our active servers within 30 days, unless retention is required by law.

Quick Sauda - Shipping Policy

1. Delivery Timeframes

• Online Grocery: 2 – 12 hours (location-based, typically same-day delivery)
• Online Food: 30 – 90 minutes (distance-based, restaurant preparation time included)
• Pharmacy: 1 – 4 hours (based on prescription verification and availability)
• General Shopping: 1 – 3 business days (standard delivery)
• Express Delivery: Available for select products with additional charges

Delivery times are estimates and may vary due to factors beyond our control, including weather conditions, traffic, product availability, and seller preparation time. During peak seasons, festivals, or special promotions, delivery times may be longer. We will notify you of any significant delays and provide updated delivery estimates.

2. Shipping Charges

• Free delivery for orders above ₹499 across most categories.
• Standard delivery fee: ₹49 for orders below ₹499.
• Express delivery may include additional charges ranging from ₹30 to ₹100 based on urgency.
• Remote area surcharge may apply for locations outside our standard delivery zones.
• Bulky item surcharge may apply for large or heavy products.
• Shipping charges are clearly displayed during checkout before payment confirmation.

3. Delivery Areas

We currently deliver to select cities and regions in Bihar and neighboring areas. To check if we deliver to your area, please enter your pin code during checkout or on our website. We are continuously expanding our delivery network to serve more locations.

4. Order Tracking

Once your order is confirmed and shipped, you will receive a confirmation email/SMS with tracking information and estimated delivery time. You can also track your order in real-time through your Quick Sauda account or via the tracking link provided.

5. Delivery Instructions

You can provide specific delivery instructions during checkout, such as leaving the package with a neighbor, security guard, or in a secure location. While we try to accommodate these requests, we cannot guarantee compliance in all cases for security reasons. For perishable items, we recommend being available to receive the delivery personally.

6. Failed Deliveries

If delivery attempts fail for the following reasons, additional charges may apply for redelivery:

• Incorrect or incomplete address provided by customer
• Recipient not available at the time of delivery
• Insufficient access to the delivery location
• Refusal to accept delivery without valid reason
• Security restrictions preventing delivery

We typically attempt delivery twice. After three failed delivery attempts, the order will be returned to the seller and a refund will be processed minus any applicable restocking fees (typically 10-15% of order value).

7. Lost or Damaged Shipments

Report damaged products immediately upon receipt with photos. Claims will be investigated promptly, typically within 24-48 hours.

• Inspect your package upon delivery before signing the delivery receipt.
• Refuse delivery if the package appears tampered with or significantly damaged.
• Report any issues within 48 hours of delivery for non-perishable items.
• Report issues within 2 hours for perishable items like food and groceries.
• Provide clear photographs of damaged items and packaging from multiple angles.
• We will arrange for replacement, partial refund, or full refund as appropriate.
• For lost shipments, contact us if your order hasn't arrived within 24 hours of the estimated delivery time.

8. Order Changes and Cancellations

You may modify or cancel your order within 15 minutes of placing it, provided the order hasn't been processed for shipping. Once an order is in the shipping process, changes cannot be guaranteed. For cancellations after the 15-minute window but before shipping, a cancellation fee of 5% may apply.

Quick Sauda - Refund Policy

1. Eligibility by Category

• Grocery: Report damaged, expired, or missing items within 48 hours of delivery.
• Food: Report incorrect, spoiled, or quality issues within 2 hours of delivery.
• Pharmacy: Non-prescription items may be returned within 7 days if unopened and in original packaging.
• General Merchandise: Eligible for return within 7 days of delivery if unused and in original condition.
• Electronics & Appliances: Manufacturer warranty applies; report defects within 10 days.
• Farming Supplies: Eligible for return within 15 days if unused and in original packaging.

The following items are generally not eligible for return unless defective or incorrect:

• Perishable groceries (fruits, vegetables, dairy, meat)
• Prepared food and meals
• Personal care items (if opened or used)
• Prescription medications (unless dispensing error)
• Items marked as 'non-returnable' or 'final sale'
• Customized or personalized products
• Innerwear and hosiery for hygiene reasons

2. Return Condition

Non-perishable items must be returned in original, unused condition with all tags, labels, and packaging intact for a full refund.

• Items must be unused, undamaged, and in original saleable condition.
• All original accessories, manuals, warranty cards, and freebies must be included.
• Return shipping is free for eligible returns initiated through proper channels.
• We reserve the right to reject returns that don't meet these conditions or show signs of use.

4. Refund Process

• Online Payments: Refunds processed within 7 business days of return approval.
• COD Refunds: Processed to bank accounts within 10 – 15 business days.
• Refunds will be issued to the original payment method used for purchase.
• For cash on delivery orders, refunds will be processed to your registered bank account.
• You will receive notification once your refund has been processed with transaction details.
• Bank processing times may add 1-3 additional business days to the refund timeline.

5. Partial Refunds

In certain circumstances, partial refunds may be granted:

• If only part of your order is returned or unavailable
• If returned items show minor signs of use or damage
• If original packaging is missing, damaged, or incomplete
• If freebies, accessories, or promotional items are not returned
• If restocking fees apply (typically 10-15% for non-defective returns)

7. Exchanges

We only replace items if they are defective, damaged, or incorrect. If you need to exchange an item for the same product, contact us within the eligible timeframe to arrange an exchange. Exchanges are subject to product availability. If the replacement product is unavailable, we will issue a refund instead.

8. Seller Responsibility

For marketplace items, the seller is responsible for accepting returns according to this policy. Quick Sauda will facilitate the return process between buyers and sellers and ensure compliance with our refund policy standards.
